Terms of service

Kia ora! Thanks for choosing SBD New Zealand.

These Terms of Trade set out the agreement between you (our valued customer) and us (the supplier of SBD Apparel). Please read them carefully. By placing an order with us, you agree to these Terms.

Definitions

We, us, our: SBD NZ Limited, trading as SBD New Zealand, and our team.

You: the customer buying our Products.

Products: the SBD Apparel we sell, including clothing, accessories, and related items.

Order: your purchase request submitted via our website, in-store, or any way we accept.

Order Price: the total amount payable for your Order, including GST and any delivery charges.

Ordering and Acceptance

Your Order is confirmed once we accept it, either by sending you a confirmation email or by dispatching your Products.

We reserve the right to decline any Order for any reason, but we’ll always let you know if that happens.

Pricing and Payment

All prices are in New Zealand dollars (NZD) and include GST unless stated otherwise.

Payment must be made in full at the time you place your Order.

If pricing errors happen, we’ll contact you before proceeding with your Order.

Delivery

We’ll send your Products to the delivery address you provide.

Delivery timeframes are estimates. We do our best, but sometimes delays happen that are out of our control.

Once the Products are delivered, the risk (like loss or damage) passes to you.

Ownership

We remain the owner of the Products until we’ve received full payment from you.

Photo Usage Consent

From time to time, we love showcasing our amazing community! By tagging us on social media or submitting photos to us, you give us permission to use those images (with or without your name) for marketing purposes, including on our website, social media, and in promotions.

If you’d rather we didn’t use your photo, no worries - just let us know at service@sbdapparel.co.nz and we’ll respect your wishes.

Consumer Rights

Our Products come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993.

If your Products are faulty or not what you ordered, you’re entitled to a repair, replacement, or refund under NZ law.

These guarantees apply only to purchases for personal use. If you’re buying for business or resale, different rules may apply.

Returns and Exchanges

We want you to love your purchase! If you change your mind, we offer exchanges or store credit within 30 calendar days of purchase (Products must be unworn and in original condition. See our Returns & Refunds Policy for full details).

Faulty or incorrect items? Contact us straight away and we’ll sort it out for you.

Warranty

Our Products are built tough, but if anything isn’t right, we’ll fix it.

We offer a 6 month warranty against defects in materials or workmanship (excluding normal wear and tear). This warranty does not cover failures due to abuse, misuse, accident or unauthorised alterations or repairs.

Liability

We are not responsible for indirect or consequential losses (like loss of profits or opportunity) under this agreement, to the fullest extent allowed by New Zealand law.

If we’re ever found liable to you, our maximum liability is limited to the Order Price you paid for the Products.

Force Majeure

If events outside our control (like natural disasters, shipping delays, or pandemics) prevent or delay us from supplying your Products, we won’t be held liable.

Default and Cancellation

If you fail to pay or breach any of these Terms, we may cancel your Order or suspend deliveries without notice.

We may also cancel an Order if we’re unable to supply the Products, but we’ll refund you in full if that happens.

Intellectual Property

All content on our website (like logos, images, product names, and designs) belongs to SBD Apparel Limited. Please don’t use it without permission.

SBD is a registered trade mark in New Zealand under case number 1029275.

Disputes

If any issues come up, let’s talk first! We’ll work in good faith to resolve any dispute quickly.

If we can’t sort it out together, either of us can refer the dispute to mediation under New Zealand law.

Changes to These Terms

We may update these Terms from time to time. The latest version will always apply to new Orders.
